Pincite Website Terms of Use
Effective: 6 August 2026
These Website Terms of Use (Terms of Use) govern your access to and use of the Pincite website, and form a binding agreement between you and Pincite Pty Ltd (ACN 700 309 753 | ABN 43 700 309 753) (Pincite, we, us, our), a company incorporated in Australia.
By accessing or browsing the Website, you agree to these Terms of Use. If you do not agree, you must not use the Website.
Capitalised terms have the meanings given to them in clause 13 (Definitions).
1. About this Website
The Website includes our marketing pages, our NZLSG Guides, our Document Index and Abbreviations Index, Pricing and reference content, and all other publicly accessible pages at https://pincite.co.nz. These Terms of Use apply to all of it.
2. Educational content, not advice
2.1 General educational purpose. Website Content, including the NZLSG Guides and our reference pages, is provided for general educational purposes only. It is not legal, academic or professional advice of any kind, and it is not a substitute for the official New Zealand Law Style Guide or for your institution's own requirements.
2.2 Accuracy. We prepare Website Content with reasonable care. Citation rules nonetheless change, are interpreted differently by different markers, and contain edge cases, and Website Content may not reflect the most current position. Subject to clause 2.3, and to the maximum extent permitted by law, we do not guarantee that Website Content is accurate, complete or current, or that it will be accepted by a particular institution, assessor or marker. You should always verify against the current NZLSG, and against your institution's requirements, before relying on it.
2.3 Your New Zealand consumer rights are preserved. Nothing in this clause 2, or elsewhere in these Terms of Use, excludes, restricts or modifies any guarantee, right or remedy you have under the Consumer Guarantees Act 1993 (NZ) or the Fair Trading Act 1986 (NZ) that cannot lawfully be excluded, restricted or modified, and nothing in these Terms of Use is intended to mislead you about those rights.
3. Our Content and permitted use
3.1 Ownership. The NZLSG Guides, our reference pages, and all text, graphics, logos and other Website Content are original works written by us, and belong to us or our licensors. They are protected by copyright.
3.2 Permitted use. You may view, read, print and use Website Content for your own personal, non-commercial study. You may link to the Website.
3.3 Restrictions. Except as expressly permitted by these Terms of Use, by us in writing, or by applicable law (including the fair dealing provisions of the Copyright Act 1994 (NZ)), you must not:
- (a) copy, reproduce, republish, communicate, distribute, sell, licence, adapt or otherwise make available any substantial part of Website Content, except for reasonable extracts used for personal, non-commercial study, quotation, criticism, review or other use permitted by law;
- (b) use Website Content, whether alone or with other material, to train, fine-tune, test, evaluate or develop any artificial intelligence, machine learning or similar automated model or system;
- (c) systematically collect, aggregate, extract or use Website Content to create, support, improve or operate a product or service that substantially reproduces, substitutes for, or competes with the Website or Pincite's services; or
- (d) use a scraper, bot, crawler, spider, script or other automated means to access, collect, extract, copy or monitor Website Content in bulk, except for ordinary search-engine indexing or where we have given prior written permission.
Nothing in this clause 3.3 prevents you from using Website Content as permitted under clause 3.2, or from exercising any right that cannot lawfully be excluded or restricted.
4. Acceptable use
You must not:
- (a) attempt to gain unauthorised access to the Website, our systems, or other users' accounts;
- (b) interfere with or disrupt the operation or security of the Website; or
- (c) use the Website for any unlawful purpose, or in a way that infringes anyone else's rights.
If you breach clause 3 (Our Content and permitted use) or this clause 4, we may block your access to the Website. Where practical, we will tell you why first, unless the conduct is causing immediate harm or is plainly unreasonable.
5. The New Zealand Law Style Guide, and no affiliation
The New Zealand Law Style Guide (3rd ed) is published by the New Zealand Law Foundation. Pincite is not affiliated with, endorsed by, or connected to the New Zealand Law Foundation, the New Zealand Law Society, or the authors or editors of the New Zealand Law Style Guide. "New Zealand Law Style Guide" and "NZLSG" are the property of their respective owners, and our use of those terms is descriptive only. Our citation output and our guides are our own implementation and explanation of the publicly available citation rules.
6. Third-party links
The Website may link to external resources. We do not control those sites and are not responsible for their content, accuracy or availability.
7. Availability
We aim to keep the Website available, but we do not guarantee uninterrupted or error-free access. We may change, add to, or remove Website Content at any time.
8. Relationship with our other documents
- (a) These Terms of Use govern general browsing of the Website.
- (b) Our Terms and Conditions govern when you create an account or subscribe.
- (c) Our Privacy Policy explains how we handle your personal information, and applies to both. It also explains that we are an Australian company and that your information is held outside New Zealand.
If there is any conflict between these Terms of Use and the Terms and Conditions, the Terms and Conditions prevail.
9. Liability
9.1 Your New Zealand consumer rights come first. Nothing in these Terms of Use excludes, restricts or modifies any guarantee, right or remedy you have under the Consumer Guarantees Act 1993 (NZ) or the Fair Trading Act 1986 (NZ) that cannot lawfully be excluded, restricted or modified. Everything else in this clause 9 is subject to this clause 9.1.
9.2 "As is". To the maximum extent permitted by law, and subject to clause 9.1, the Website and Website Content are provided on an "as is" and "as available" basis, and we exclude all warranties, conditions and guarantees other than those that cannot be excluded by law.
9.3 Excluded loss. To the maximum extent permitted by law, we are not liable for any indirect, consequential, special or incidental loss, or for loss of profits, opportunity, goodwill or data, arising from your use of, or reliance on, the Website or Website Content. Without limiting clause 9.1, we are not liable for any mark, grade, course outcome or academic outcome. Nothing in this clause excludes liability to the extent it arises from our failure to comply with a guarantee or other obligation that cannot lawfully be excluded, restricted or modified, or any obligation we have under applicable privacy law in relation to personal information.
9.4 Liability we do not exclude. Nothing in these Terms of Use excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited.
10. Changes to these Terms of Use
We may update these Terms of Use from time to time. An updated version takes effect when it is published on the Website, unless it states a later effective date, and the "Effective" date above records when the current version took effect.
By continuing to access or use the Website after an updated version takes effect, you agree to be bound by it. Where a change is material and it is reasonably practicable to do so, we may give notice of the change on the Website or by another reasonable method. We are not required to give individual notice to users who access the Website without an account.
11. Governing law
11.1 These Terms of Use are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State. We are an Australian company and this is the law under which we operate both of our sites.
11.2 Clause 11.1 does not exclude, restrict or modify any right, guarantee or remedy you have under the Consumer Guarantees Act 1993 (NZ), the Fair Trading Act 1986 (NZ) or the Privacy Act 2020 (NZ) that cannot lawfully be excluded, restricted or modified. It does not prevent you from complaining to the Commerce Commission or the Office of the Privacy Commissioner, or from bringing proceedings in a New Zealand court or the Disputes Tribunal where the law gives you the right to do so. The jurisdiction submitted to is non-exclusive, so neither you nor we are prevented from bringing proceedings in another court that has jurisdiction.
